CrustWise Terms of Use

These Terms of Use ('Terms') govern the relationship between you and SZÁM-SZINT Kereskedelmi és Szolgáltató Korlátolt Felelősségű Társaság (SZÁM-SZINT Kft.), the operator of CrustWise, in relation to the CrustWise app and CrustWise Pro. By downloading, accessing or using CrustWise, you agree to these Terms. Your download and use of the app are also subject to Apple's Standard Licensed Application End User License Agreement and applicable App Store terms. These Terms supplement, and do not replace, those Apple terms. Mandatory consumer rights that cannot lawfully be excluded or limited remain unaffected.

For clarity, SZÁM-SZINT has not supplied a custom App Store EULA for CrustWise; Apple's Standard Licensed Application End User License Agreement applies to the licence delivered through the App Store. These Terms govern additional matters between you and SZÁM-SZINT, including CrustWise Pro, safety, support and consumer-law matters. If a provision of these Terms conflicts with a mandatory rule of law, the mandatory rule prevails.

1. What CrustWise is

CrustWise is a cooking and baking companion designed to help users plan dough formulas, fermentation, equipment choices, guided cooking steps, timers, bake records and iterative improvements. Some features are available free of charge and additional convenience, persistence, analysis or companion-device features may require CrustWise Pro.

2. Eligibility and minors

You must be legally capable of accepting these Terms under the law applicable to you. CrustWise is not intended to remove the need for adult supervision in the kitchen. If you are a minor, use CrustWise only with the permission and appropriate supervision of a parent, guardian or responsible adult, particularly when using ovens, grills, broilers, hot baking surfaces, steam, knives or other potentially hazardous equipment.

3. Licence to use CrustWise

Subject to these Terms, Apple's Standard Licensed Application End User License Agreement and applicable law, you receive a personal, limited, non-exclusive and non-transferable licence to use CrustWise on Apple devices permitted by Apple's applicable usage rules, for personal or internal lawful use. Any suspension or termination of that licence will occur only in accordance with these Terms, the applicable Apple terms and mandatory law.

You may not, except where applicable law expressly permits it:

• copy, redistribute, sell, rent, sublicense or commercially exploit CrustWise or its protected content;
• reverse engineer, decompile, disassemble or attempt to derive source code from CrustWise;
• circumvent access controls, purchase entitlements or technical protections;
• use CrustWise in a way that interferes with its operation or infringes the rights of SZÁM-SZINT or others; or
• use CrustWise for unlawful purposes.

4. Free features and CrustWise Pro

CrustWise Free is intended to allow users to make supported bakes using the core cooking workflow. CrustWise Pro may provide additional features such as reusable saved custom recipes, automated bake-improvement analysis, richer insights, Experiment Lab features, Apple Watch functionality and Home Screen widget functionality.

The feature set may evolve as CrustWise is updated for valid reasons such as improving functionality, security, compatibility, legal compliance or product development. We will not describe unavailable cloud sync as a current v1 benefit. Features shown before purchase should be read together with the current App Store product description and in-app purchase screen. Changes affecting paid digital content or services remain subject to the consumer protections described in Section 11.

5. Purchases, subscriptions and billing

CrustWise Pro may be offered through Apple In-App Purchase as an auto-renewable subscription and/or a one-time, non-consumable 'Lifetime' purchase, depending on the options shown in the app and App Store at the time of purchase. A Lifetime purchase is a one-time entitlement to the applicable CrustWise Pro features for as long as the purchased app/product is made available and supported; it is not a promise that CrustWise, every feature, or compatibility with future hardware or operating systems will exist indefinitely. This does not limit any mandatory rights relating to paid digital content.

• Payment is processed by Apple through your Apple Account. SZÁM-SZINT does not receive your payment-card details.
• For auto-renewable subscriptions, the subscription name, duration, features and full renewal price are shown before you confirm the purchase. Subscriptions provide access to the applicable Pro features during the paid subscription period.
• Subscriptions renew automatically at the end of each subscription period unless cancelled through Apple before renewal in accordance with Apple's subscription-management rules. Apple handles charging, renewal and any applicable price-change process through your Apple Account.
• You can manage or cancel an Apple subscription through your Apple Account/App Store subscription settings.
• Restore Purchases may be used where supported to restore eligible entitlements associated with your Apple Account.
• Because purchases are made through Apple In-App Purchase, refund and billing requests may be handled through Apple's applicable processes and terms. This does not limit mandatory statutory remedies or claims that you may have against SZÁM-SZINT under applicable consumer law.

6. Digital-content consumer rights

If you are a consumer, applicable law gives you mandatory rights concerning the supply and conformity of digital content or digital services. Depending on the circumstances, these may include the right to have non-conforming digital content or services brought into conformity, a proportionate price reduction, or termination and reimbursement. Required updates and other remedies remain governed by applicable law. Nothing in these Terms excludes or restricts rights that cannot legally be excluded.

A statutory withdrawal right may apply to a distance purchase, subject to applicable exceptions for digital content or services. In particular, applicable law may permit the withdrawal right to be lost after performance begins where the required prior express consent and acknowledgement have been obtained. Because CrustWise purchases are completed through Apple, the App Store purchase flow records the purchase and presents the applicable transaction terms. This paragraph does not waive any withdrawal right that you have under mandatory law.

7. Cooking and physical safety

Cooking and baking involve inherent risks, including burns, fire, hot surfaces, steam, sharp tools, heavy equipment, smoke, foodborne illness and appliance-specific hazards. CrustWise is a planning and guidance tool; it does not control your oven, equipment, ingredients or physical environment.

• Always follow the instructions, safety warnings, temperature limits and operating requirements supplied by the manufacturer of your oven and other equipment.
• Do not exceed appliance, cookware, baking-steel, baking-stone or accessory limits.
• Keep flammable materials away from heat sources, broilers, grills and exposed heating elements.
• Use appropriate heat protection and safe handling practices around hot surfaces, pans, stones, steels and steam.
• Maintain appropriate food hygiene, storage and cooking practices and consider the needs of vulnerable persons.
• Do not rely on an app timer as the sole safety control for unattended cooking.
• If CrustWise guidance conflicts with manufacturer instructions, applicable safety requirements or conditions you can observe in your kitchen, follow the safer applicable instruction and stop if necessary.

8. Recipes, calculations and guidance

Recipes, baker's percentages, fermentation estimates, timings, temperatures, nutrition estimates, improvement suggestions and other guidance are provided as practical cooking aids. Actual results vary with ingredients, equipment, ambient conditions, measurement accuracy, food handling and user technique.

You remain responsible for checking quantities, settings, temperatures, allergens, ingredient suitability and the condition of food and equipment before acting on guidance. CrustWise is not a substitute for professional food-safety, medical, nutritional, electrical, gas, fire-safety or appliance advice.

9. Allergies, intolerances and nutrition

CrustWise is not an allergy-management or medical application. Ingredient and nutrition information may be incomplete, estimated or dependent on user-entered data. If you or another person has an allergy, intolerance, medical condition or special dietary requirement, independently verify all ingredients, labels, cross-contamination risks and relevant professional guidance.

10. User-created content and local data

You retain your rights in recipe names, notes, bake records and other content you create. In v1, CrustWise is designed to store core baking data locally rather than in a SZÁM-SZINT-operated cloud account. Because SZÁM-SZINT does not hold a server copy of that core local data, it generally cannot recover it for you if it is deleted or lost. You are responsible for maintaining your device and any backups you choose to use. Deleting the app or local data may permanently remove locally stored CrustWise information.

11. Availability, updates and changes

We may maintain, fix, improve or modify CrustWise, including its user interface and feature set, for valid reasons such as security, legal compliance, compatibility, correcting defects, improving functionality or continued operation. Where CrustWise supplies paid digital content or services over a period of time, modifications beyond what is necessary to maintain conformity will be made only as permitted by applicable law. Where required, we will provide clear advance information about a negatively affecting modification and any applicable right to terminate or continue using an unmodified version.

We do not promise that CrustWise will be uninterrupted or error-free at all times. Device compatibility may depend on supported Apple hardware and operating-system versions.

12. Intellectual property

CrustWise, its software, branding, visual design, original text, recipe presentation, illustrations and other protected materials are owned by or licensed to SZÁM-SZINT, except for user-created content and third-party materials identified as such. These Terms do not transfer ownership of CrustWise or its intellectual property to you.

13. Third-party platforms

CrustWise relies on Apple platform services for distribution and certain functionality, including the App Store, StoreKit, Apple Watch, widgets, Live Activities, Siri/App Intents and local system notifications. You must comply with applicable third-party terms when using those services. Your use of Apple services is also subject to Apple's applicable terms and privacy policies. SZÁM-SZINT is not responsible for the operation of third-party platform services outside its reasonable control, without limiting SZÁM-SZINT's obligations for CrustWise under mandatory law.

14. Disclaimer and liability

To the maximum extent permitted by applicable law, CrustWise is provided as a cooking-assistance tool and no guarantee is made that a particular recipe, fermentation schedule, timer, calculation or recommendation will produce a particular culinary result.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability that cannot be excluded for intentional conduct or for harm to life, physical integrity or health, and nothing limits mandatory consumer remedies. To the extent permitted by law, SZÁM-SZINT is not liable for loss to the extent it is caused by the user's misuse of CrustWise, disregard of manufacturer instructions or safety warnings, unsafe equipment or ingredients, materially inaccurate user inputs, or circumstances outside SZÁM-SZINT's reasonable control.

You should not use CrustWise as the sole means of preventing fire, burns, foodborne illness, equipment damage or other physical harm.

15. Suspension or termination

You may stop using CrustWise at any time. We may restrict access where reasonably necessary and proportionate to protect security, comply with law or address material misuse or breach of these Terms. Where appropriate and legally permitted, we will give reasonable notice or an opportunity to remedy the issue. Any action affecting paid digital content remains subject to applicable mandatory consumer rights and the terms governing the relevant App Store purchase.

16. Governing law and consumer protection

These Terms are governed by Hungarian law, without depriving a consumer of mandatory protections that apply under the law of the consumer's country of habitual residence where those protections cannot lawfully be waived.

Before starting formal proceedings, you are encouraged to contact us at support@szamszint.hu so we can try to resolve the issue. This does not restrict your right to contact a competent authority, conciliation body or court. Hungarian consumers may use the competent regional conciliation body (békéltető testület) for an individual consumer dispute after first attempting to resolve the complaint directly with us; current conciliation-body information is published by the Hungarian consumer-protection authority. Consumers in other countries may have equivalent local remedies.

17. Changes to these Terms

We may update these Terms to reflect changes to CrustWise, law, security or business practices. The current version will be published at the Terms URL below. Where applicable law requires advance notice, consent or another specific process for a material change, we will follow that requirement.
